The taxation treatment of Conacre letting as a trading activity within Northern Ireland has been well established for many years. However, the McClean case has fundamentally shifted conventional thought on the taxation of conacre. Subsequent HMRC activity has demonstrated that the taxation treatment of conacre has changed. This is a matter of extreme concern to both practitioners and the wider public. With an estimated 30% of land in Northern Ireland let under conacre the implications of this case be far reaching.

Speakers: Philip McCall Solicitor of J W McNinch will discuss the facts of the McClean case. Philip was an executor of the Will in the case and was involved throughout all aspects of the original case & appeals. Mike Nangle Chartered Accountant of Dawson Nangle Tumelty will review the background to Conacre and analyse HMRC's approach to conacre subsequent to the decision in the case. He will also look at possible planning solutions to protect the taxation position of land let in conacre.
